1. Acceptance of these terms
By creating an account or using FlowGap (the "Service"), you agree to these Terms of Service. FlowGap is operated by ExpertFocus LLC ("ExpertFocus," "we," or "us"). If you do not agree, do not use the Service.
2. What the Service is
FlowGap is a guided self-assessment for outpatient mental health practices. You answer questions about how your practice operates; we score your answers against published industry benchmarks and generate a report with prioritized recommendations, including references to third-party tools and services.
3. Not medical, legal, financial, or compliance advice
The Service provides general business-operations information and is not a substitute for professional advice. Nothing in a FlowGap report constitutes clinical, legal, tax, financial, or regulatory-compliance advice, and we are not responsible for decisions you make based on it. Recommendations of third-party vendors are informational; we do not guarantee their pricing, availability, or fitness for your practice, and we are not responsible for your dealings with them.
4. No patient or client information
The Service is designed to collect information about how your practice operates — not information about your patients or clients. Do not enter any patient- or client-identifiable information, including in free-text fields. You are responsible for ensuring nothing you submit contains such information.
5. Accounts
You must provide accurate information when creating an account and are responsible for activity under your account and for keeping your credentials secure. You must be authorized to complete this assessment on behalf of the practice you represent.
6. Fees and payment
The first three Flow Factors are free. The complete assessment and report are a one-time fee, shown at checkout, processed securely by Stripe — we do not store your card details. Prices may change for future purchases; a purchase you've already completed is not affected.
7. Refunds
We offer an unconditional refund if requested within 14 days of purchase — no reason required. Contact us to request one; see our Contact page.
8. Intellectual property
The Service, including its assessment framework, scoring methodology, and content, is owned by ExpertFocus LLC and protected by applicable intellectual property laws. Your report is yours to use for your own practice; you may not resell or redistribute the Service itself.
9. Disclaimers and limitation of liability
The Service is provided "as is" without warranties of any kind. We do not guarantee any particular business outcome from following a report's recommendations. To the fullest extent permitted by law, ExpertFocus LLC's total liability arising from your use of the Service will not exceed the amount you paid us in the twelve months before the claim arose.
10. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these terms, including submitting patient- or client-identifiable information in violation of Section 4.
11. Changes to these terms
We may update these terms from time to time. Continued use of the Service after a change takes effect constitutes acceptance of the updated terms.
12. Governing law
These terms are governed by the laws of the state in which ExpertFocus LLC is organized, without regard to conflict-of-law principles.
